These Terms of Service ("Terms") govern your use of Acme Agent Supply, LLC ("ACME," "we," "us," or "our") products, services, and website (collectively, the "Services"). By accessing or using the Services, you agree to these Terms.
1. Acceptance of Terms
By using our Services, you confirm that you are at least 18 years old, have the authority to agree to these Terms on behalf of yourself or your organization, and agree to be bound by these Terms and our Privacy Policy.
2. Services
ACME provides AI agent reliability software including RadCheck, Sentinel, Agent911, SphinxGate, DriftGuard, Watchdog, Lazarus, Transmission, FindMyAgent, and related tools. The Services are provided "as is" and we reserve the right to modify, suspend, or discontinue them at any time with reasonable notice.
3. Accounts
You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. Notify us immediately at support@acmeagentsupply.com of any unauthorized use.
4. Acceptable Use
You agree not to:
- Use the Services to violate any applicable law or regulation
- Reverse engineer, decompile, or attempt to extract source code from the Services
- Use the Services to develop competing products without prior written consent
- Transmit malware, spam, or other harmful content through the Services
5. Billing and Payments
Paid plans are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by law or at our sole discretion. We reserve the right to change pricing with 30 days' notice.
6. Intellectual Property
ACME retains all rights, title, and interest in the Services. These Terms do not grant you any rights to our trademarks, logos, or other brand elements.
7. Data and Privacy
Your use of the Services is also governed by our Privacy Policy. You retain ownership of data you submit to the Services. You grant ACME a limited license to use that data solely to provide and improve the Services.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ACME SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNTS YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.
9. Disclaimer of Warranties
THE SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
10. Termination
Either party may terminate these Terms at any time. Upon termination, your right to use the Services ceases immediately. Provisions that by their nature should survive termination will survive.
11. Governing Law
These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict of law principles. Disputes shall be resolved in the courts of Worcester County, Massachusetts.
12. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes via email or prominent notice in the Services. Continued use after the effective date constitutes acceptance.
